Toshakhana-II case: final arguments underway – HUM News


ISLAMABAD: The Toshakhana-II case against Pakistan Tehreek-i-Insaf (PTI) founder Imran Khan and his wife, Bushra Bibi, has entered its final phase on Wednesday, with the defence expected to present its closing arguments before Special Judge Central Shahrukh Arjumand at Adiala Jail.

The hearing follows the prosecution’s completion of its concluding arguments a day earlier, during which the Federal Investigation Agency (FIA) outlined its case alleging that the couple retained valuable state gifts, including a Bulgari jewellery set gifted by the Saudi royal family, at grossly undervalued prices, resulting in a loss to the national exchequer.

The proceedings, which have alternated between the judicial complex in Islamabad and Adiala Jail due to security reasons, mark the culmination of months of testimony and cross-examinations. During earlier hearings, the court recorded statements from key witnesses, including private appraiser Sohaib Abbasi and Imran Khan’s former personal secretary, Inamullah Shah, whose testimonies form the basis of the prosecution’s claims.

Abbasi, in his statement recorded on September 18, alleged that he was pressured by Shah into undervaluing the Bulgari jewellery set at Rs5 million. He told the court that Shah visited him in May 2022, insisting that the valuation not exceed that figure and warning that refusal to comply could lead to his blacklisting from government departments. Abbasi admitted that he submitted a false assessment report and later sought a pardon during the investigation phase.

Shah corroborated portions of Abbasi’s account, telling the court that he had indeed asked the appraiser to lower the valuation and remained in his office during the process. He also disclosed that he had been drawing dual salaries, from the Prime Minister’s Office and the PTI Secretariat, during his tenure as Imran Khan’s personal secretary, adding that he was eventually removed from his post due to Bushra Bibi’s disapproval.

Earlier, on September 16, Judge Arjumand had also summoned two army officers, former military secretary Brig Muhammad Ahmed and deputy military secretary Col Rehan, to testify in connection with the gift’s documentation and custody records. Both were directed to record their statements in subsequent proceedings.

Toshakhana II: IHC rejects request to transfer case to another bench

In a hearing on October 14, the court concluded the testimony stage and formally notified the defence of the schedule for final arguments. The prosecution, led by FIA Special Public Prosecutor Zulfiqar Abbas Naqvi, opened its closing arguments on Monday, detailing the alleged procedural violations and financial irregularities in the retention of the Toshakhana gifts.

The case, initially investigated by the National Accountability Bureau (NAB), was transferred to the FIA last year on the orders of an Islamabad court. The special court will also rule on the bail applications filed by Imran and Bushra Bibi once the arguments conclude.

Imran Khan took to his X account to reiterate his views about the case calling it “fabricated” Toshakhana-II case, alleging it is being rushed to secure his conviction and prevent his release. He claimed key prosecution testimony was proven false and that military officials confirmed all gift records followed rules. Khan said other cases against him, the Cipher and Al-Qadir Trust cases, were also politically motivated and baseless, accusing authorities of selective justice while ignoring alleged wrongdoing by rivals. He argued that Pakistan now operates under “Asim Law”, where allies of the powerful are protected and opponents persecuted, warning that continued injustice will devastate the country.

Khan, who has been incarcerated since August 2023, is currently serving a sentence in the £190 million corruption case. He also faces multiple other trials, including those under the Anti-Terrorism Act related to the May 9, 2023, protests.

With both sides nearing the end of their arguments, the Toshakhana-II proceedings are expected to reach a decisive point in the coming days, as the court prepares to reserve its verdict on the high-profile case.
